หลายคนอาจยังเข้าใจผิดคิดว่า การแต่งงานกับคนไทย มีบัญชีธนาคารไทย หรือมีเอกสาร คร.22 แล้ว จะสามารถอาศัยอยู่ในประเทศไทยระยะยาวได้ทันที แต่ในความเป็นจริง เอกสารทั้งหมดนี้เป็นเพียงส่วนประกอบหนึ่งเท่านั้น สิทธิ์ในการอยู่อาศัยในประเทศไทยอย่างถูกต้องตามกฎหมายจะขึ้นอยู่กับ “วีซ่า” เพียงอย่างเดียว

สรุปคือ เอกสารต่างๆ เป็นเพียงเอกสารประกอบการพิจารณาวีซ่า ที่ต้องทำอยู่เรื่อยๆทุกปี


⬩➤ หน้าที่ของเอกสารแต่ละตัว
  • การจดทะเบียนสมรส: เป็นสิทธิ์ทางกฎหมายในฐานะคู่สมรส (เช่น เรื่องการแบ่งทรัพย์สิน) แต่ไม่ได้ให้สิทธิ์ในการอยู่อาศัยระยะยาว
  • ใบ คร.22 (ทะเบียนฐานะแห่งครอบครัว): สำหรับคู่ที่จดทะเบียนสมรสในต่างประเทศ นำเอกสารไปผ่านกระบวนการรับรอง แปลเป็นภาษาไทย และนำไปแจ้งที่อำเภอ เพื่อออกใบ คร.22 ใช้เป็นใบแทนทะเบียนสมรสสำหรับติดต่อหน่วยงานในไทย
  • บัญชีธนาคารไทย: เป็นเอกสารแสดงคุณสมบัติทางการเงินจากธนาคาร ไม่ใช่เอกสารอนุญาตให้อยู่ในประเทศ การมีแค่บัญชีอย่างเดียวไม่ได้ยืนยันว่ามีเงินเพียงพอตามเกณฑ์

⬩➤ เงื่อนไขเรื่อง “เงินในบัญชี”

การยื่นขอวีซ่า Non-O กรณีติดตามคู่สมรสไทย กำหนดให้ต้องมีเงินฝากในบัญชีธนาคารไทย ไม่น้อยกว่า 400,000 บาท ตามเกณฑ์ที่กฎหมายกำหนด

ปกติแล้ว การจะเปิดบัญชีธนาคารไทยในปัจจุบัน ธนาคารมักจะเรียกขอวีซ่า Non-O จากนอกประเทศก่อน แต่กรณีที่ชาวต่างชาติมีบัญชีธนาคารไทยอยู่แล้ว (อาจเพราะเคยเปิดไว้นานแล้ว เคยเรียน หรือเคยทำงานในไทย) จะช่วยให้วางแผนดำเนินการต่อได้ 2 ทางเลือก

⬩➤ ทางเลือกที่ 1: เปลี่ยนประเภทวีซ่าภายในประเทศไทย
  • นำเงินเข้าบัญชีธนาคารไทยให้ครบ 400,000 บาท
  • เข้าไปสอบถามและขอเปลี่ยนประเภทวีซ่า (จากวีซ่าท่องเที่ยวหรือผ่อนผัน) เป็น Non-O คู่สมรส ได้ที่สำนักงานตรวจคนเข้าเมือง (ตม.) ในพื้นที่ที่คุณลงทะเบียน ตม.30 ไว้
  • ข้อควรระวัง: ตม. แต่ละพื้นที่อาจมีดุลยพินิจไม่เหมือนกัน บางพื้นที่อาจอนุญาตให้เปลี่ยนได้ทันที (จะได้สิทธิ์อยู่เบื้องต้น 90 วัน) แต่บางพื้นที่อาจไม่อนุญาตให้เปลี่ยนในไทย และแนะนำให้เดินทางออกไปยื่นขอ Non-O จากนอกประเทศก่อน


⬩➤ ทางเลือกที่ 2: เดินทางออกไปยื่นขอวีซ่า Non-O จากนอกประเทศ (Thai E-Visa)

หาก ตม. ในไทยไม่อนุญาตให้เปลี่ยนวีซ่า จะต้องเดินทางออกนอกประเทศเพื่อยื่นขอผ่านระบบออนไลน์ (Thai E-Visa) โดยมี 2 แนวทาง:

1. ยื่นขอที่ประเทศบ้านเกิดตัวเอง (แนะนำที่สุด): ยื่นผ่านระบบออนไลน์ ได้รับวีซ่าทางอีเมล แล้วค่อยเดินทางกลับเข้าไทย

2. ยื่นขอที่ประเทศเพื่อนบ้าน (เช่น ลาว, เวียดนาม, มาเลเซีย):

  • ต้องเดินทางข้ามประเทศไปก่อน เพื่อนำ ตราประทับเข้าเมืองของประเทศนั้นๆ มาอัปโหลดลงในระบบ Thai E-Visa (ไม่สามารถนั่งกรอกเอกสารล่วงหน้าจากในไทยได้)
  • หากไป ประเทศลาว หลังจากยื่นออนไลน์แล้ว ต้องเดินทางไปชำระเงินที่สถานทูตไทยในลาวด้วยตนเอง
  • หากไป เวียดนาม หรือ มาเลเซีย สามารถจ่ายเงินออนไลน์ได้ แต่ต้องรออยู่ในประเทศนั้นๆ จนกว่าวีซ่าจะอนุมัติ และบางกรณีสถานทูตอาจเรียกตรวจหนังสือเดินทาง (Passport) เพิ่มเติม


⬩➤ ขั้นตอนหลังจากได้รับวีซ่า Non-O 90 วันแรก

ไม่ว่าจะเปลี่ยนวีซ่าในไทยสำเร็จ หรือเดินทางไปขอจากต่างประเทศกลับเข้ามา:

  1. คุณจะได้รับสิทธิ์อยู่อาศัยเบื้องต้น 90 วัน
  2. นำเงินฝากเข้าบัญชีธนาคารไทยจำนวน 400,000 บาท และ ต้องคงเงินไว้ในบัญชีให้ครบ 2 เดือน
  3. เมื่อครบกำหนด 2 เดือน ให้ไปขอใบรับรองจากธนาคาร ปรับสมุดบัญชี (Update Book) และขอ Statement
  4. นำเอกสารทั้งหมดไปยื่นเรื่องขอ “อยู่ต่อรายปี” ที่ ตม. ซึ่งจะได้รับอนุญาตให้อยู่ต่อได้ครั้งละ 1 ปี และสามารถยื่นต่ออายุได้เป็นประจำทุกๆ ปี

Why Do You Still Need a Non-O Visa?

Many people might misunderstand and think that being married to a Thai, having a Thai bank account, or having a Khor.Rhor. 22 document allows a foreigner to stay in Thailand long-term right away. But in reality, all these documents are just parts of a puzzle. Your legal right to stay in Thailand long-term depends on the “Visa” alone.

In short, all these documents are just supporting files for the visa application, which you need to renew every year.


⬩➤ What each document actually does
  • Marriage Registration: Gives you legal rights as a spouse (such as sharing assets), but it does not give you the right to stay long-term.
  • Khor.Rhor. 22 (Family Status Register): Used when you registered your marriage abroad. You must verify the document, translate it into Thai, certify the translation, and bring it to a local district office (Amphoe) in Thailand. They will issue a Khor.Rhor. 22 form to replace the marriage certificate for official use inside Thailand.
  • Thai Bank Account: Shows your financial background from a bank, but it is not a permit to stay. Just having an account does not prove you have enough money.
  • Non-O Visa: The official permit to stay in Thailand long-term, which requires collecting all the documents mentioned above to apply.


⬩➤ The “Money in the Bank” Requirement
  • When applying for a Non-O visa based on marriage to a Thai, the law requires you to have at least 400,000 Thai Baht in a Thai bank account.
  • Normally, banks in Thailand today require a Non-O visa from abroad before allowing you to open an account. However, if the foreigner already has a Thai bank account (perhaps opened long ago, or from former work or study in Thailand), this gives you two ways to move forward:

⬩➤ Option 1: Change Visa Type Inside Thailand
  • Transfer 400,000 Baht into your Thai bank account.
  • Ask to change your visa type (from a Tourist Visa or Visa Exemption) to a Non-O Marriage Visa at the local Immigration office where you filed your TM.30 form.
  • Caution: Each Immigration office has different strictness. Some offices will let you change inside Thailand (giving you an initial 90-day stay), but some offices will not allow it and will tell you to apply for a Non-O visa outside Thailand instead.


⬩➤ Option 2: Apply for a Non-O Visa Outside Thailand (Thai E-Visa)

If local Immigration does not allow you to change inside Thailand, you must travel abroad to apply online through the Thai E-Visa system:

1. Apply in Your Home Country (Best Option): Apply online, receive your visa via email, and fly back to Thailand.

2. Apply in a Neighboring Country (e.g., Laos, Vietnam, Malaysia):

  • You must travel into that country first to get an entry stamp, and upload that stamp into the Thai E-Visa system (you cannot just apply online from inside Thailand).
  • In Laos: After submitting online, you must go to the Thai Embassy in person to pay the fee.
  • In Vietnam or Malaysia: You can pay online, but you must stay in that country until your visa is approved. In some cases, the embassy may also request to see your actual passport.


⬩➤ Steps After Getting Your 90-Day Non-O Visa

Whether you change your visa in Thailand or return from abroad with a Non-O visa:

  1. You will receive an initial stay of 90 days.
  2. Keep 400,000 Baht in your Thai bank account and leave it untouched for a full 2 months.
  3. After 2 months, get a bank guarantee letter, update your passbook, and request a bank statement.
  4. Take all documents to Immigration to apply for a 1-year extension of stay. After that, you can extend your stay once every year.
