Married to a Foreigner and Want to Move Back to Thailand: Do You Need a Visa?

For Thai citizens who have lived abroad for a long time and want to move back to Thailand with their spouse—either to live or retire—you might wonder if you still need to apply for a visa yourself. Here is a complete summary of the steps and important things you need to know:.

⬩➤ 1. For Thais: Do You Need a Visa?

If you still have a Thai passport:

  • Whether it is expired or not expired: You are still considered a Thai citizen, so you do not need a visa. You can enter Thailand normally.
  • If your Thai passport has expired: Bring two passports with you (your foreign passport and your expired Thai passport) and present the Thai passport to the immigration officer. The officer will allow you to enter the country. After entering, go get a new Thai passport and then update your information at the local immigration office near your home.
  • Important note: Entering/leaving the country and boarding flights rely strictly on your passport. Airlines at your point of origin will not accept just a Thai national ID card; you must show a Thai passport.

If you have renounced your Thai citizenship:

  • If you no longer have a Thai passport (including cases where you renounced your citizenship and your Thai passport was canceled), you must enter Thailand as a foreign national.
  • You can apply for a Non-O visa for former Thai citizens (Thai nationals who abandoned their citizenship) to enter the country.

⬩➤ 2. For Foreign Spouses: How Should They Prepare?

Option 1: Non-O Marriage Visa (Accompanying a Thai Spouse)

  • Requirements: You must present a marriage certificate and have at least 400,000 THB in a Thai bank account (or a monthly income of at least 40,000 THB).

Option 2: Non-O Retirement Visa

  • Requirements: You must be at least 50 years old and have at least 800,000 THB in a Thai bank account (or a monthly income of at least 65,000 THB).
  • Advantage: You do not need to present a marriage certificate during the visa application process, making it easier and quicker.

Document Preparation and Visa Application Steps for Your Spouse

⬩➤ 1. Apply for a Non-O Visa Before Coming to Thailand:

Your foreign spouse should apply for a Non-O visa online through the Thai E-Visa website from abroad before traveling.

Do not enter Thailand on a Visa Exemption (Free Visa): You will not be able to open a Thai bank account, which will prevent you from converting or extending your visa inside the country.

⬩➤ 2. Certifying a Foreign Marriage Certificate (For Non-O Marriage Visa or Obtaining Kor Ror 22):
  • If married in Thailand: You can use your Thai marriage certificate right away.
  • If married abroad: You must take your foreign marriage certificate through the document legalization process as follows:
    1. Take your foreign marriage certificate, foreign passport, divorce certificate (if any), and name-change certificate (if any) to be legalized at the Ministry of Foreign Affairs of that country.
    2. Have the documents certified at the Thai Embassy in that country (some embassies may require an English translation as well).
    3. Translate the documents into Thai and certify the translation at the Department of Consular Affairs, Ministry of Foreign Affairs in Thailand.
    4. Take the fully certified documents to any district office (Amphoe/Khet) in Thailand to apply for a Kor Ror 22 (Family Status Registration).

Recommendation: If applying for a Non-O Marriage Visa, it is best to complete the document legalization process before coming to Thailand. However, if coming on a Non-O Retirement Visa, you can travel first and handle document legalization and Kor Ror 22 later. (Getting Kor Ror 22 is still very important for legal rights and managing marital assets in Thailand).

⬩➤ 3. Opening a Bank Account in Thailand:
  • For Non-O Marriage Visa: The bank will ask for your Kor Ror 22 document and the translated foreign marriage certificate.
  • For Non-O Retirement Visa: The bank will not ask for a marriage certificate, but will require proof of address in Thailand, such as a Notification Form for House-Master (TM.30) from immigration or a Yellow House Book (the Yellow House Book requires a certified foreign passport).

⬩➤ 4. Depositing Funds and Applying for an Extension of Stay:
  • Once the account is open, transfer the required amount of money according to the visa criteria (400,000 THB for a Marriage Visa or 800,000 THB for a Retirement Visa).
  • Keep the money deposited in the bank account for at least 2 months.
  • After 2 months, bring your financial proof to apply for a long-term extension of stay at your local immigration office.
  • If using an Income Certificate instead of a bank deposit: The income document must be certified (if it is already in English, most immigration offices accept it directly; if it is in another language, it must be translated into English first). Whether you still need to open a bank account may depend on the requirements of each local immigration branch.
