การขอวีซ่า Non-O คู่สมรส (กรณีจดทะเบียนสมรสในต่างประเทศ)

สำหรับผู้ที่จดทะเบียนสมรสในต่างประเทศ และต้องการขอวีซ่า Non-O คู่สมรส เพื่อเข้ามาและขออยู่ต่อในประเทศไทย สามารถทำได้เช่นเดียวกับคนที่จดทะเบียนสมรสในไทย เพียงแต่จะมีขั้นตอนเพิ่มขึ้นมานิดหน่อย เนื่องจากไม่สามารถจดทะเบียนสมรสซ้ำในไทยได้

สิ่งสำคัญที่ต้องจำไว้คือ เราต้องนำทะเบียนสมรสต่างประเทศมาทำเรื่อง “คร.22” (บันทึกทะเบียนฐานะแห่งครอบครัว) เพื่อให้ทางการไทยยอมรับก่อนนั่นเอง


⬩➤ ขั้นตอนที่ 1: การขอวีซ่า Non-O จากต่างประเทศ (ก่อนเข้าไทย)

การขอวีซ่าในขั้นตอนแรก ต้องยื่นขอออนไลน์จากต่างประเทศผ่านเว็บไซต์ Thai E-Visa (www.thaievisa.go.th) เท่านั้น ไม่สามารถเดินทางเข้ามาทำในไทยได้ตั้งแต่แรก

  • ข้อดีของการยื่นจากต่างประเทศ: สามารถใช้เอกสารหลักฐานของประเทศนั้นๆ ได้เลย ทั้งบัญชีธนาคารและทะเบียนสมรสต่างประเทศ เพราะสถานทูตไทยในประเทศนั้นมีความคุ้นเคยกับเอกสารท้องถิ่นอยู่แล้ว จึงยังไม่ต้องนำไปแปลเป็นภาษาไทยในขั้นตอนนี้
  • วิธีดำเนินการ: เข้าเว็บไซต์ Thai E-Visa > กรอกใบสมัคร > อัปโหลดเอกสาร > จ่ายค่าวีซ่า > รอสถานทูตอนุมัติ
  • ระยะเวลารอ: ปกติใช้เวลาประมาณ 2–3 สัปดาห์ (หรืออาจนานกว่านั้นขึ้นอยู่กับแต่ละประเทศ)

💡 ข้อแนะนำ: ในช่วงที่กำลังรอสถานทูตอนุมัติวีซ่า ควรเริ่มเตรียมเอกสารสำหรับนำมาใช้ในไทยล่วงหน้าได้เลย เพื่อไม่ให้เสียเวลาครับ



ขั้นตอนที่ 2: การเตรียมเอกสารต่างประเทศเพื่อทำ คร.22
เนื่องจากเอกสารที่จะนำไปยื่นกับอำเภอ/สำนักงานเขตในไทย ต้องเป็นภาษาไทยทั้งหมด จึงต้องผ่านกระบวนการรับรองเอกสารดังนี้:

⬩➤ 1. เอกสารของชาวต่างชาติที่ต้องนำไปรับรองตัวจริง:
  • หนังสือเดินทาง (Passport)
  • ทะเบียนสมรสต่างประเทศ
  • ทะเบียนหย่า (กรณีเคยหย่ามาก่อน)
  • ใบเปลี่ยนชื่อ-นามสกุล (ถ้ามี)
  • ใบรับรองรายได้ (กรณีต้องการใช้เกณฑ์รายได้ยื่นวีซ่า)

⬩➤ 2. ลำดับการรับรองเอกสาร (2 สถาบัน):
  1. นำเอกสารไปรับรองตัวจริงที่ กระทรวงการต่างประเทศของประเทศนั้นๆ (หรือหน่วยงานที่รับผิดชอบ)
  2. นำไปรับรองต่อที่ สถานทูตไทย ณ ประเทศนั้นๆ

⬩➤ 3. การแปลภาษาและรับรองคำแปล:

เมื่อรับรองเอกสารจากต่างประเทศเรียบร้อยแล้ว ก็นำมา แปลเป็นภาษาไทย และนำไปยื่นรับรองคำแปลที่ กรมการกงสุล กระทรวงการต่างประเทศ (ในประเทศไทย)

⚠️ คำเตือนเรื่องการมาทำรับรองเอกสารในไทย: หากเดินทางมาถึงไทยแล้วค่อยมาทำรับรองเอกสารที่สถานทูตต่างประเทศในไทย สามารถทำได้ในบางประเทศเท่านั้น แต่ควรเช็คให้ดีก่อนเพราะบางสถานทูตไม่รับทำ หรือหากรับก็อาจรอคิวยาวจนทำเรื่องไม่ทัน ดังนั้น แนะนำให้ทำกระบวนการรับรองเอกสารให้เสร็จสิ้นตั้งแต่ก่อนเดินทางมาไทยจะดีที่สุด




⬩➤ ขั้นตอนที่ 3: การยื่นทำ คร.22 และเปิดบัญชีธนาคารไทย

เมื่อเดินทางเข้าประเทศไทยด้วยวีซ่า Non-O (จะได้ตราประทับอยู่ได้ 90 วัน) ให้รีบดำเนินการตั้งแต่เดือนแรกทันทีตามลำดับดังนี้:

  1. ยื่นทำ คร.22: นำเอกสารต่างประเทศที่แปลและรับรองคำแปลไทยเรียบร้อยแล้ว ไปติดต่อ สำนักงานเขตหรือที่ว่าการอำเภอใดก็ได้ (ไม่จำเป็นต้องเป็นอำเภอใกล้บ้าน หรืออำเภอตามทะเบียนบ้าน) เพื่อออกเอกสาร คร.22 (บันทึกทะเบียนฐานะแห่งครอบครัว)
  2. เปิดบัญชีธนาคารไทย: นำเอกสาร คร.22 ทะเบียนสมรสต่างประเทศ และพาสปอร์ต ไปยื่นขอเปิดบัญชีธนาคารในไทย
  3. การนำเงินเข้าบัญชี (เลือกตามเกณฑ์ที่ใช้):
    • เกณฑ์เงินฝาก: ฝากเงิน 400,000 บาท เข้าบัญชีธนาคารไทย และต้องฝากเงินค้างบัญชีต่อเนื่องให้ครบ 2 เดือน
    • เกณฑ์รายได้: บาง ตม. ก็กำหนดให้เปิดบัญชีธนาคารไทยและโอนเงินเข้าสม่ำเสมอ 2 เดือนเช่นกัน ดังนั้นไม่ว่าจะใช้เกณฑ์ไหนก็หลีกเลี่ยงการเปิดบัญชีธนาคารไม่ได้


⬩➤ ขั้นตอนที่ 4: การยื่นขออยู่ต่อรายปี กับ ตม.

เมื่อฝากเงินครบกำหนด 2 เดือนแล้ว ให้ดำเนินการยื่นขออยู่ต่อดังนี้:

  1. ขอหนังสือรับรองธนาคาร (Bank Guarantee): ไปขอใบรับรองจากธนาคารและอัปเดตสมุดบัญชี ในวันเดียวกันกับวันที่ไปยื่นเรื่องขออยู่ต่อที่ ตม.
  2. เดินทางไป ตม.: นำเอกสารทั้งหมด ได้แก่ ทะเบียนสมรสต่างประเทศ, เอกสาร คร.22, เอกสารทางการเงิน และเอกสารอื่นๆ ไปยื่นเรื่องที่สำนักงานตรวจคนเข้าเมือง (ตม.)

💡 ไม่ต้องจ้างเอเจนซี่: ทาง ตม. กำหนดให้เจ้าตัวต้องเดินทางไปด้วยตัวเองอยู่แล้ว ดังนั้นสามารถไปทำเองได้เลย เจ้าหน้าที่ ตม. ใจดีและพร้อมให้คำแนะนำเป็นอย่างดี



⬩➤ ข้อควรระวังที่สุด! (เรื่องระยะเวลา)

เมื่อเดินทางเข้าไทยด้วยวีซ่า Non-O ครั้งแรก คุณจะได้ระยะเวลาอนุญาตอยู่ได้ 90 วัน

หากคุณเริ่มทำเรื่องช้า เอกสาร คร.22 ไม่เสร็จ หรือฝากเงินไม่ทันครบ 2 เดือน จนเกินกำหนด 90 วัน คุณจะไม่สามารถยื่นขออยู่ต่อในไทยได้ และกลายเป็น “หนังชีวิต” ที่ต้องเดินทางออกนอกประเทศไทย เพื่อไปเริ่มขั้นตอนขอวีซ่า Non-O จากต่างประเทศใหม่อีกรอบ ทำให้เสียทั้งเวลาและค่าใช้จ่าย

Guide to Applying for a Non-O Spouse Visa (When Married Abroad)

For those who registered their marriage in another country and want to apply for a Non-O Spouse Visa to live in Thailand, you can do so just like those who registered their marriage in Thailand. The only difference is that there are a few extra steps because you cannot register your marriage twice (you cannot re-register it in Thailand).

The key thing to remember is that you must turn your foreign marriage certificate into a Thai document called “Khor.Ror.22” (Family Registration Record) so that it is officially recognized by the Thai government.


⬩➤ Step 1: Apply for the Non-O Visa from Abroad (Before Entering Thailand)

First, you must apply for the visa online from outside Thailand through the Thai E-Visa website (www.thaievisa.go.th). You cannot start this first step inside Thailand.

  • Advantage of applying from abroad: You can use your foreign supporting documents right away (such as foreign bank statements and your foreign marriage certificate). The Thai embassy in that country is already familiar with local documents, so you don’t need to translate them into Thai at this stage.
  • How to apply: Go to the Thai E-Visa website > Fill out the application form > Upload your documents > Pay the visa fee > Wait for embassy approval.
  • Processing time: It usually takes about 2 to 3 weeks (or longer depending on the country).

💡 Tip: While waiting for visa approval, you should start preparing the documents you will need once you arrive in Thailand so you don’t waste time later.



Step 2: Prepare Foreign Documents for Khor.Ror.22
Because any foreign documents submitted to Thai government offices (like the district office/Amphur) must be in Thai, you need to complete the following authentication process:

⬩➤ 1. Original Foreign Documents That Need Legalization:
  • Passport
  • Foreign Marriage Certificate
  • Divorce Certificate (if previously divorced)
  • Name/Surname Change Certificate (if applicable)
  • Proof of Income Certificate (if using the income method for the visa)

⬩➤ 2. Legalization Steps (2 Offices):
  1. Get the original documents legalized at the Ministry of Foreign Affairs (or the responsible agency) in that country.
  2. Get them legalized again at the Royal Thai Embassy/Consulate in that country.

⬩➤ 3. Translation and Certification:

Once legalized abroad, bring the documents to be translated into Thai, and then have the translations certified at the Department of Consular Affairs, Ministry of Foreign Affairs in Thailand.

⚠️ Warning about legalizing documents in Thailand: Trying to legalize documents through a foreign embassy located in Thailand might be possible for some countries, but you should check carefully first. Some embassies do not offer this service, or the waiting line might be too long, causing delays. It is strongly recommended to complete all document legalizations before travelling to Thailand.




⬩➤ Step 3: File for Khor.Ror.22 & Open a Thai Bank Account

When you arrive in Thailand with your Non-O Visa (which gives you a 90-day initial stay), start these steps right away during your first month:

  1. File for Khor.Ror.22: Take your translated and certified documents to any District Office (Amphur/Khet) in Thailand (it does not have to be near your home or house registration address) to issue the Khor.Ror.22 document.
  2. Open a Thai Bank Account: Take your Khor.Ror.22, foreign marriage certificate, and passport to open a bank account in Thailand.
  3. Deposit Funds (Based on the criteria you use):
    • Money Deposit Method: Deposit 400,000 Thai Baht into your Thai bank account and keep it in the account continuously for at least 2 months.
    • Income Method: Some immigration offices still require a Thai bank account and proof of monthly transfers for 2 months. Therefore, opening a Thai bank account is unavoidable regardless of which method you choose.


⬩➤ Step 4: Apply for the 1-Year Extension with Immigration (TM)

Once the money has been in the account for 2 full months (and while your 90-day visa is still valid):

  1. Get a Bank Guarantee Letter: Request a bank guarantee letter and update your bank passbook on the exact same day you go to apply for the extension.
  2. Go to Immigration: Bring all your documents—foreign marriage certificate, Khor.Ror.22, financial proof, and other required items—to apply for the Extension of Stay at the Immigration Office.

💡 No need to hire an agency: Immigration requires you to apply in person anyway, so you can easily do it yourself. Immigration officers are helpful and will guide you through the process.



⬩➤ Crucial Time Warning!

When you first enter Thailand on a Non-O Visa, you are granted a 90-day stay.

If you delay the process, fail to complete Khor.Ror.22 on time, or fail to keep the money in the bank for 2 months before your 90 days run out, you will not be able to extend your stay in Thailand. You will have to leave the country and restart the entire Non-O Visa process from abroad all over again, wasting time and money.
