การจดทะเบียนสมรสในไทย จะให้สิทธิ์คู่สมรสเต็มขั้นตามกฎหมายไทยทันที แต่การจะมีผลบังคับใช้หรืออ้างอิงสิทธิ์ในต่างประเทศ จำเป็นต้องแจ้งให้ทางการของประเทศนั้นๆ รับทราบก่อน เพราะหน่วยงานไทยไม่ได้แจ้งข้อมูลข้ามประเทศให้อัตโนมัติ

• สิทธิ์ในประเทศไทย: ฝ่ายชาวต่างชาติจะได้สิทธิ์ขอวีซ่าติดตามคู่สมรสเพื่ออาศัยในไทยระยะยาว ส่วนฝ่ายไทยจะได้สิทธิ์ในทรัพย์สินของคู่สมรสตามกฎหมายไทย หากฝ่ายต่างชาติเสียชีวิต ทรัพย์สินและมรดกในไทยจะตกเป็นของคู่สมรสและบุตรตามกฎหมาย

• สิทธิ์ในต่างประเทศ: ครอบคลุมถึงสิทธิ์ในทรัพย์สิน มรดก หรือเงินบำนาญจากต่างประเทศ แต่จำเป็นต้องแจ้งเรื่องกับสถานทูตเพื่อขอรับสิทธิ์
  • ข้อสังเกตเรื่องเงินบำนาญ: กรณีคู่สมรสเสียชีวิตและเราขอรับสิทธิ์บำนาญต่อ เงินที่ได้รับมักจะลดลงจากเดิม (เช่น อาจเหลือประมาณครึ่งหนึ่ง) เนื่องจากปรับลดตามจำนวนคนที่เหลืออยู่

ลักษณะสิทธิ์ที่ต้องการจะแบ่งออกตามวัตถุประสงค์:

• การขอวีซ่าและการพำนักระยะยาว: การมีทะเบียนสมรสไทยจะช่วยให้การยื่นขอวีซ่าเพื่อไปอยู่อาศัยในประเทศของคู่สมรสทำได้ง่ายขึ้น รวมถึงการขอถิ่นที่อยู่ถาวร (Permanent Resident) หรือการขอถือสัญชาติ/พาสปอร์ต ซึ่งต้องดำเนินการไปตามขั้นตอนของประเทศนั้นๆ
• เรื่องมรดกและเอกสารทางกฎหมาย: การแจ้งเรื่องไว้กับสถานทูตจะช่วยอำนวยความสะดวกอย่างมากหากเกิดปัญหาหรือจำเป็นต้องเรียกร้องสิทธิ์ในภายหลัง

ทะเบียนสมรสไทยเป็นภาษาไทยและออกโดยอำเภอในไทย สถานทูตหรือหน่วยงานต่างประเทศจึงต้องมีการตรวจสอบความถูกต้อง การแจ้งเรื่องจึงไม่สามารถทำได้เพียงแค่การบอกกล่าว แต่ต้องเตรียมเอกสารผ่าน 3 ขั้นตอน ดังนี้:

1. รับรองเอกสารตัวจริง: นำทะเบียนสมรสไทยตัวจริงไปรับรองความถูกต้องที่กรมการกงสุล กระทรวงการต่างประเทศของไทย
2. แปลเอกสาร: แปลทะเบียนสมรสเป็นภาษาที่ประเทศนั้นๆ กำหนด (บางประเทศรับภาษาอังกฤษ เช่น สหรัฐอเมริกา หรืออังกฤษ แต่บางประเทศต้องแปลเป็นภาษาท้องถิ่น เช่น ภาษาเยอรมัน หรือภาษาฝรั่งเศส)
3. รับรองคำแปล: นำเอกสารที่แปลแล้วไปรับรองคำแปลให้ถูกต้องตามขั้นตอน

เมื่อทำครบทั้ง 3 ขั้นตอนแล้ว จึงทำการนัดหมายกับสถานทูตเพื่อยื่นแจ้งเรื่องต่อไป

ในทางกฎหมาย การจดทะเบียนสมรสสามารถทำได้เพียงครั้งเดียว เพราะการจดทะเบียนต้องใช้ “ใบโสด” เมื่อจดทะเบียนสมรสในไทยแล้ว ทางการไทยจะไม่สามารถออกใบโสดให้ได้อีก จึงไม่สามารถนำไปจดทะเบียนสมรสซ้ำในต่างประเทศได้

สิ่งที่ทำได้สำหรับคนที่ต้องการย้ายไปอยู่อาศัยถาวร คือการทำ “ใบแทนทะเบียนสมรส” (คล้ายกับใบ ค.ร.22 ของไทย) ซึ่งเป็นการคัดลงทะเบียนประวัติการสมรสให้เป็นเอกสารที่ประเทศนั้นๆ ยอมรับ

• กรณีไม่ได้ย้ายไปอยู่ยาว (ไปเที่ยวหรือเยี่ยมเยียนสั้นๆ): เช่น เดินทางไม่เกิน 90 วัน (วีซ่าเชงเกน) หรือไม่เกิน 6 เดือน (วีซ่าอังกฤษ) ไม่จำเป็นต้องทำถึงขั้นทำใบแทนทะเบียนสมรส เพียงนำทะเบียนสมรสไทยไปแปลเป็นภาษาอังกฤษก็เพียงพอต่อการใช้งาน

• กรณีต้องการย้ายไปอยู่อาศัยถาวร: จำเป็นต้องทำตามขั้นตอน 3 ขั้นตอนข้างต้น และอาจต้องเดินทางไปดำเนินการทำใบแทนทะเบียนสมรสที่ประเทศปลายทางเพิ่มเติม

• กรณีแจ้งเรื่องมรดกหรือบำนาญจากในไทย: สำหรับหลายๆ ประเทศ (เช่น อังกฤษ, เบลเยียม, เยอรมนี, ออสเตรีย, สหรัฐอเมริกา, สวิตเซอร์แลนด์, ฝรั่งเศส, อิตาลี, เนเธอร์แลนด์ ฯลฯ) หากเป็นการแจ้งเรื่องเพื่อรักษาสิทธิ์หรือขอรับบำนาญโดยไม่ได้ย้ายไปอยู่ สามารถติดต่อผ่านสถานทูตของประเทศนั้นๆ ที่ตั้งอยู่ในประเทศไทยได้เลย โดยไม่จำเป็นต้องเดินทางบินไปต่างประเทศ

Registering your marriage in Thailand grants you full marital rights under Thai law immediately. However, for these rights to be recognized or referenced in a foreign country, you must notify that country’s government. Thai local district offices do not automatically forward your information internationally.

• Rights in Thailand: The foreign spouse gains the right to apply for a long-term marriage visa. The Thai spouse gains rights regarding the partner’s assets located in Thailand. If the foreign spouse passes away, assets and inheritance in Thailand are distributed among the surviving spouse and children according to Thai law.

• Rights Overseas: This covers assets, inheritance, or pension funds located abroad. You must notify the relevant embassy to claim these rights.
  • Note on Pensions: If a spouse passes away and you apply to claim their foreign pension, the payout is usually reduced (often by about half) since the benefit was originally meant for two people.

Your required steps depend on what you want to achieve:

• Visas and Long-Term Residence: A Thai marriage certificate makes applying for a spouse visa to live in your partner’s country much easier. It also serves as the first step if you plan to apply for Permanent Residency (PR) or citizenship later.
• Inheritance and Legal Matters: Filing your marriage record with the embassy early on makes it much simpler to claim inheritance or resolve legal matters later.

Because a Thai marriage certificate is written in Thai and issued by Thai authorities, foreign embassies cannot accept it as-is. You must prepare the document through three official steps:

1. Legalize the Original Document: Have the original Thai marriage certificate certified by the Department of Consular Affairs (Ministry of Foreign Affairs of Thailand).
2. Translate the Document: Translate the certified document into the language required by that country (some countries accept English, while others require their native language, such as German or French).
3. Certify the Translation: Have the translated document officially certified for accuracy.

Once these three steps are complete, you can schedule an appointment with the embassy to submit your notice.

Legally, you can only register a marriage once. Marriage registration requires a Certificate of Single Status (Affidavit of Single Status). Once you are married in Thailand, Thai authorities will no longer issue a single status certificate. Therefore, registering the same marriage a second time abroad is legally impossible.

If you plan to move permanently, what you obtain instead is an official Marriage Record / Registration Entry in that country’s system (similar to Thailand’s Kor. Ror. 22 form).

• Short Visits (Holidays or Trips Under 3–6 Months): If you are visiting short-term (e.g., up to 90 days on a Schengen visa or up to 6 months in the UK), you do not need to record the marriage in their national registry. Having your Thai marriage certificate translated into English is generally sufficient.

• Moving Permanently: If you plan to relocate long-term, completing the 3-step document certification and applying for the foreign marriage record entry is required.

• Claiming Inheritance or Pension from Thailand: For many countries (such as the UK, Belgium, Germany, Austria, the US, Switzerland, France, Italy, the Netherlands, etc.), if you only need to protect your rights or claim a pension while remaining in Thailand, you can complete the notification process through their embassy in Bangkok. You do not need to travel abroad.
