ชาวต่างชาติไม่ได้จดทะเบียนสมรสกับคนไทย แต่มีลูกเป็นคนไทย ต้องทำวีซ่าอะไร

สำหรับชาวต่างชาติที่มีบุตรกับคนไทย แต่ยังไม่ได้จดทะเบียนสมรสกันตามกฎหมาย ทำให้ไม่สามารถขอ วีซ่าคู่สมรส (Non-O Spouse) ได้ หลายคนอาจกังวลว่าจะอยู่เมืองไทยต่อได้ไหม?
คำตอบคือ “ทำได้” โดยมี 2 ทางเลือกหลัก ดังนี้


➤ทางเลือกที่ 1: วีซ่าเกษียณ (Non-O Retirement)

ถ้าอายุถึงเกณฑ์ วิธีนี้คือวิธีที่ ง่ายและจัดการเอกสารน้อยที่สุด เพราะไม่ต้องพิสูจน์ความสัมพันธ์ทางครอบครัว


เงื่อนไขหลัก:

  • อายุ 50 ปีขึ้นไป
  • มีเงินฝากในบัญชีธนาคารไทยไม่น้อยกว่า 800,000 บาท * หรือ มีรายได้/บำนาญ ต่อเดือนไม่น้อยกว่า 65,000 บาท

ข้อดี-ข้อเสีย:

  • ✅ ข้อดี: ขั้นตอนไม่ยุ่งยาก ไม่ต้องใช้เอกสารยืนยันความสัมพันธ์กับบุตรหรือภรรยา
  • ❌ ข้อเสีย: ต้องมีเงินทุนตามเกณฑ์ที่กำหนด และในทางกฎหมายจะไม่มีสิทธิผูกพันกับครอบครัวคนไทย


➤ทางเลือกที่ 2. วีซ่าติดตามบุตร (Non-O Family)

หากอายุยังไม่ถึง 50 ปี หรือต้องการใช้สิทธิในฐานะ “พ่อ” คุณสามารถใช้ สูติบัตรของลูก แทนทะเบียนสมรสเพื่อขอวีซ่าได้

เงื่อนไขสำคัญ:

  • ลูกต้องมี สูติบัตรไทย และมีสัญชาติไทยเท่านั้น
  • พ่อชาวต่างชาติต้องมีสถานะเป็น “บิดาโดยชอบด้วยกฎหมาย”
  • เกณฑ์การเงิน: ต้องมีเงินฝากในบัญชีไทย 400,000 บาท หรือมีรายได้ต่อเดือน 40,000 บาทขึ้นไป (เท่ากับเกณฑ์วีซ่าแต่งงาน)


➤วิธีเตรียม “สูติบัตรไทย” สำหรับลูก

1. กรณีเด็กเกิดในประเทศไทย

  • แจ้งเกิดได้ที่สำนักงานเขต หรือที่ว่าการอำเภอ ตามเขตที่เกิด
  • จะได้รับ “สูติบัตรไทย” ทันที และได้สัญชาติไทยตามมารดา

2. กรณีเด็กเกิดในต่างประเทศ

กรณีนี้เด็กจะไม่ได้สัญชาติไทยโดยอัตโนมัติ ต้องดำเนินการเพิ่มเติมเพื่อให้ได้สิทธิ:

  • หลักฐานยืนยัน: เนื่องไม่ได้จดทะเบียนสมรส อาจต้องใช้ ผลตรวจ DNA หรือหลักฐานอื่นๆ เพื่อยืนยันความเป็นบิดามารดาประกอบการพิจารณาของเจ้าหน้าที่
  • การขอสูติบัตร: พ่อหรือแม่ที่มีสัญชาติไทยต้องพาลูกไปยื่นเรื่องที่ สถานทูตไทย/สถานกงสุลไทย ในประเทศนั้นๆ ด้วยตนเอง (ควรนัดหมายล่วงหน้า)


➤ แนวทางการยื่นขอวีซ่า
กรณีที่ 1: ปัจจุบันอยู่ในไทย + มีบัญชีธนาคารไทยแล้ว ▼

วิธีทำ: ติดต่อสอบถาม ตม. ในพื้นที่เพื่อขอเปลี่ยนประเภทวีซ่า (จากฟรีวีซ่าหรือวีซ่าท่องเที่ยว เป็น Non-O)

ข้อควรระวัง: ตม. บางแห่งอาจเข้มงวดและปฏิเสธการเปลี่ยนวีซ่าในประเทศ โดยจะบังคับให้ออกไปยื่นขอนอกประเทศแทน


กรณีที่ 2: ไม่มีบัญชีธนาคารไทย (หรือ ตม. ให้ไปขอนอกประเทศ) ▼
  1. เดินทางออกนอกประเทศไทย: เนื่องจากระบบ Thai E-Visa ไม่อนุญาตให้ยื่นขอขณะอยู่ในไทย
  2. ยื่นผ่านระบบ Thai E-Visa:
    • เลือกหมวดหมู่ To stay with Thai family more than 60 days
    • เอกสารทางการเงิน: ใช้บัญชีธนาคารต่างประเทศของตัวเอง หรือให้พ่อ/แม่เด็กที่เป็นคนไทย (หรือญาติสายตรง) เซ็นรับรองเป็นสปอนเซอร์ร่วมได้
  3. เดินทางกลับเข้าไทย: หลังได้รับวีซ่าทางอีเมล จะได้สิทธิ์อยู่ในไทย 90 วัน
  4. เปิดบัญชีและฝากเงิน: นำวีซ่า Non-O ไปเปิดบัญชีธนาคารไทย แล้วฝากเงิน 400,000 บาท ค้างไว้ในบัญชีอย่างน้อย 2 เดือน
  5. ยื่นขออยู่ต่อ (Extension of Stay): เมื่อครบ 2 เดือน ให้ขอ Statement วันเดียวกับที่จะไปยื่นเรื่อง แล้วนำไปยื่นขอต่ออายุวีซ่ารายปีกับ ตม.

ข้อควรระวังสำคัญ

  • ห้ามยื่น E-Visa ขณะตัวยังอยู่ในประเทศไทย เพราะ ตม./สถานทูต จะตรวจเช็กสแกนหนังสือเดินทางทุกหน้า และจะถูกปฏิเสธวีซ่าทันที
  • ห้ามปลอมแปลง Statement หรือกู้ยืมเงินในลักษณะที่ผิดกฎหมาย

No Marriage Certificate? How Foreigners with Thai Children Can Stay in Thailand

If you are a foreigner who has a child with a Thai partner but you are not legally married, you cannot apply for a Non-O Marriage Visa. However, you still have two primary legal options to stay in Thailand with your family.


➤ Option 1: Non-O Retirement Visa

If you meet the age requirement, this is often the easiest and fastest path because it does not require legal proof of family relationship.


Key Requirements:

  • Must be 50 years of age or older.
  • Financial Criteria: A deposit of at least 800,000 THB in a Thai bank account OR a monthly income/pension of at least 65,000 THB.

Pros & Cons:

❌ Cons: Requires a higher financial threshold; does not grant any legal parental rights over the child.

✅ Pros: Simpler documentation; no need to prove paternity or marital status.



➤ Option 2: Non-O Family Visa

If you are under 50 or prefer to stay based on your parental role, you can use your child’s Thai Birth Certificate instead of a marriage certificate.

Key Requirements:

  • The child must have Thai Nationality and a Thai Birth Certificate.
  • The father must be recognized as the “Legal Father” (Legitimation of Child).
  • Financial Criteria: A deposit of 400,000 THB in a Thai bank account OR a monthly income of at least 40,000 THB.


➤ How to Obtain a “Thai Birth Certificate”

1. Born in Thailand

  • Process: Register the birth at the local District Office (Amphur or Khet) where the birth occurred.
  • Result: You will receive a Thai Birth Certificate immediately, and the child receives Thai citizenship through the mother.

2. Born Abroad

Thai citizenship is not always automatic if the birth happens outside Thailand. You must take additional steps:

  • Process: The Thai parent must bring the child to the Thai Embassy or Consulate in that country to apply for a Thai Birth Certificate. (An advance appointment is usually required).
  • Evidence: Since there is no marriage certificate, the authorities may require DNA test results or other evidence to confirm biological paternity/maternity.


➤ How to Apply
Case 1: You are currently in Thailand + You already have a Thai bank account ▼

What to do: Contact the local Immigration office to ask if you can change your visa type (from Tourist Visa or Visa Exemption to Non-O).

Warning: Some Immigration offices are strict and will not let you change it inside Thailand. They may force you to leave the country to apply.


Case 2: You do NOT have a Thai bank account ▼

(or Immigration asks you to apply outside Thailand)

  1. Leave Thailand: The Thai E-Visa system does not allow you to apply while staying inside Thailand.
  2. Apply via Thai E-Visa website:
    • Choose the category To stay with Thai family more than 60 days.
    • Financial Proof: You can use your overseas bank account, or have the Thai parent (or direct relative) sign as a joint sponsor.
  3. Return to Thailand: Once you receive your visa by email, you will get a 90-day entry stamp when returning to Thailand.
  4. Open a Bank Account & Deposit Money: Use your Non-O visa to open a Thai bank account, then deposit 400,000 THB and leave it in the account for at least 2 months.
  5. Apply for Visa Extension: After 2 months, get a bank statement updated on the same day you visit Immigration, then apply for a 1-year extension.

Important Warnings

  • Do NOT apply for an E-Visa while you are inside Thailand. Embassy staff check every passport page scan and will reject your application immediately.
  • Do NOT use fake bank statements or illegal loans.
