(Legalization):

Guide to Marriage Registration Certificate (Khor.Rhor.22) and Retiring in Thailand for Couples Married Abroad

For couples who registered their marriage abroad and wish to move back to live in Thailand, an important question is: “Do we need to register our marriage again in Thailand?”

The answer is you cannot re-register your marriage in Thailand. Under Thai law, a certificate of single status is required for marriage registration. Therefore, instead of registering again, you must record your foreign marriage certificate into the Thai registry system. This document is called the “Family Status Registration Certificate” or “Khor.Rhor.22” (คร.22).

If you choose not to apply for Khor.Rhor.22, you can still live in Thailand. However, your legal marriage status will only be recognized in foreign countries, not in Thailand. This can affect your visa options, property rights, medical decision-making, and long-term residence in Thailand.

⬩➤ 1. What is Khor.Rhor.22, and Why is it Useful?

Khor.Rhor.22 is an official document used in place of a Thai marriage certificate for couples who married abroad. It makes your foreign marriage fully valid under Thai law, and you only need to apply for it once to cover your entire marriage life.

Key Benefits of Khor.Rhor 22:

  • Visa Application: Used as an essential document to apply for and extend a long-term Non-O Spouse Visa.
  • Property and Inheritance Rights: Protects your rights regarding marital assets and legal inheritance under Thai law.
  • Financial and Legal Transactions: Used together with your foreign marriage certificate to open a Thai bank account, buy or sell real estate, or serve as evidence in legal disputes.

⬩➤ 2. Steps to Apply for Khor.Rhor.22 (Preparation)

Applying for Khor.Rhor.22 does not require a certificate of single status or an interview. The process focuses mainly on document verification through the following 4 steps:

  1. Document Legalization:
    • Take the foreign spouse’s passport, original marriage certificate, and name change/divorce certificates (if applicable) to be certified by the Ministry of Foreign Affairs of that country.
    • Next, take the documents to be certified by the Royal Thai Embassy in that country (total of 2 certifications).
    • Recommendation: Completing this while still abroad is the most convenient option. However, if necessary, you can process this through that country’s embassy in Thailand (though it may take longer).
      ↓
  2. Translate into Thai: Have the certified original documents fully and accurately translated into the Thai language.
    ↓
  3. Certify the Translation at the Consular Department: Submit the Thai translations to the Department of Consular Affairs (Ministry of Foreign Affairs in Thailand) for official certification.
    ↓
  4. Submit at the Local District Office: Bring all certified documents to a local district office (Amphoe/Khet) in Thailand to issue the Khor.Rhor.22.
    • Recommendation: Call the specific district office beforehand, as some offices may request additional documents, such as a proof of single status for the Thai spouse.

⬩➤ 3. Non-O Visa Options for Retired Husbands

To move to Thailand after retirement, you have two main options for a Non-O Visa. You must apply online via the Thai e-Visa system with the Royal Thai Embassy abroad before traveling to Thailand (as a Non-O visa is required to open a Thai bank account).

Option 1: Non-O Retirement VisaOption 2: Non-O Marriage Visa (Requires Khor.Rhor.22)
Best for those with sufficient funds who want to avoid marriage document steps.Best for those who meet lower financial criteria or want to save funds.
Fewer documents; tied solely to bank account criteria.Reduces required financial funds by half.
• 800,000 THB deposited in a Thai bank account, OR
• Monthly income of at least 65,000 THB
• 400,000 THB deposited in a Thai bank account, OR
• Monthly income of at least 40,000 THB
Must maintain at least 400,000 THB in the account for 3 months after visa approval.Must keep the deposit seasoned in a Thai bank account for at least 2 months before applying for extension.

Steps After Arriving in Thailand (Initial Visa Valid for 90 Days)

  1. Non-O Retirement Track: Open a Thai bank account → Deposit funds for 2 months → Apply for a 1-year visa extension.
  2. Non-O Marriage Track: Obtain Khor.Rhor.22 at the district office → Open a bank account (using passport + Non-O visa + foreign marriage certificate + Khor.Rhor.22) → Deposit funds for 2 months → Request a bank statement and apply for a 1-year visa extension.

Note: You can enter Thailand under a Non-O Retirement Visa first, and process your Khor.Rhor.22 document in Thailand later.

⬩➤ 4. Other Impacts of Not Having Khor.Rhor.22
  • Property and Marital Assets: Under Thai law, foreigners cannot directly own land or houses (they can only own up to a specific quota in condominiums). Most properties are therefore registered under the Thai spouse’s name. Without Khor.Rhor.22, Thai law does not recognize you as a married couple. Properties bought or built in Thailand belong solely to the person named on the title deed and cannot be divided as marital assets in a dispute or death. (While a last will can be made, it can be altered anytime; Khor.Rhor.22 offers more reliable legal protection.)
  • Medical Decisions: In critical medical emergencies requiring life-support decisions, hospitals in Thailand may not recognize a foreign spouse without Khor.Rhor.22, potentially delaying decisions while waiting for immediate family members abroad.
  • Permanent Residence (PR) Application: Foreigners on a Non-O Retirement Visa are not eligible to apply for PR. However, foreigners on a Non-O Marriage Visa (with Khor.Rhor.22) are eligible under the Thai family category (after holding Khor.Rhor.22 for at least 5 years, or 2 years if you have children together, plus paying taxes in Thailand for at least 3 consecutive years).

⬩➤ Summary

Can you skip Khor.Rhor.22? Yes, if you have the funds ready for a Non-O Retirement Visa (800,000 THB) and accept the risks regarding property rights, emergency medical decisions, and disqualification from permanent residency.

Why is Khor.Rhor.22 beneficial? Although it requires document preparation at first, doing it once protects your rights for life. It cuts the visa bank deposit requirement in half (to 400,000 THB), protects your marital asset rights under Thai law, gives you medical decision rights, and opens the door to permanent residence in the future.
