🟢 ข้อดี

• สถานะมั่นคง: หากเกิดกรณีคู่สมรสไทยเสียชีวิต หรือมีการหย่าร้างกัน ชาวต่างชาติยังคงรักษา status เพื่ออยู่เมืองไทยต่อได้ โดยเปลี่ยนมาใช้สิทธิ์การติดตามลูกแทน

• ลูกโตเมืองนอกก็ทำได้: ลูกที่เกิดในต่างประเทศ สามารถขอสูติบัตรไทย และต่อยอดไปทำพาสปอร์ตไทยเพื่ออยู่ไทยถาวรได้โดยไม่ต้องขอวีซ่า

• ไม่จำกัดอายุของลูก: ลูกจะอายุเท่าไหร่ก็สามารถใช้สิทธิ์ให้ทางบิดา/มารดาต่างชาติขอวีซ่านี้ได้

• เอกสารง่ายกว่า: ถ้ามีสูติบัตรไทยของลูกแล้วคือจบเลย ไม่ต้องยุ่งยากเรื่องการนำทะเบียนสมรสต่างประเทศไปรับรอง แปลไทย และรับรองกงสุลซ้ำซ้อน

🔴 ข้อเสีย

• เกณฑ์การเงินเท่าเดิม: ยังคงต้องใช้หลักฐานแสดงฐานะทางการเงินในระดับเดียวกับวีซ่า NON-O คู่สมรส (เงินฝาก 400,000 บาท หรือรายได้ 40,000 บาท/เดือน)

✔️ บุตรต้องเป็นสายเลือดแท้ๆ ของบิดาหรือมารดาที่เป็นคนไทย (จะได้สัญชาติไทยโดยกำเนิด)

✔️ “บุตรบุญธรรม” ไม่สามารถขอได้ทุกกรณี (ขอสูติบัตรที่เปลี่ยนชื่อพ่อแม่จริงๆเป็นพ่อแม่บุญธรรมไม่ได้ ถ้าต้องการขอวีซ่าติดตามบุตรบุญธรรม ต้องทำใบทะเบียนรับบุตรบุญธรรม(ค.ร.14) ไม่ใช่ทำสูติบัตร เพราะเด็กมีสูติบัตรที่เป็นพ่อแม่จริงๆอยู่แล้ว)

✔️ ต้องมายื่นเอกสารและสัมภาษณ์ด้วยตัวเองเท่านั้น ที่สถานทูตไทยในต่างประเทศ หรือที่ว่าการอำเภอในประเทศไทย

1. สูติบัตรต่างประเทศของลูก:

• ถ้ายื่นที่สถานทูตไทยในต่างประเทศ: ต้องนำสูติบัตรต่างประเทศไปรับรองตัวจริงจากหน่วยงานต้นทางของประเทศนั้นๆ

• ถ้ายื่นที่อำเภอในไทย: ต้องนำพาสปอร์ตลูก + สูติบัตรต่างประเทศ ไปรับรองตัวจริงจากประเทศต้นทางหรือสถานทูตประเทศนั้นๆ ในไทย + แปลเป็นภาษาไทย + นำไปรับรองการแปลที่กรมการกงสุลไทย

2. พาสปอร์ต หรือ บัตรประจำตัวของลูก

3. บัตรประชาชน + พาสปอร์ตไทย (ของพ่อหรือแม่ที่เป็นคนไทย)

4. ทะเบียนสมรสของพ่อแม่

จำเป็นต้องขอวีซ่า NON-O ผ่านระบบออนไลน์เข้ามาก่อน เพื่อนำวีซ่านี้มาเปิดบัญชีธนาคารในไทยสำหรับใช้ยื่นขออยู่ต่อระยะยาว

• ระยะเวลาดำเนินการ: ประมาณ 10 – 14 วัน (วีซ่าจะส่งให้ทางอีเมล)

เอกสารที่ต้องใช้อัปโหลดระบบออนไลน์:

• กรอกใบสมัครออนไลน์ + จ่ายค่าวีซ่าผ่านระบบ
• สูติบัตรไทยของลูก
• หลักฐานการเงิน: เงินฝากในบัญชีธนาคาร 400,000 บาท หรือ ใบแสดงรายได้ 40,000 บาท/เดือน (ขั้นตอนนี้ใช้เอกสาร/บัญชีธนาคารเป็นภาษาต่างประเทศได้)

เมื่อเดินทางเข้าไทยแล้ว ก่อนวีซ่า 90 วันจะหมดอายุ ให้ไปยื่นเรื่องขออยู่ต่อที่สำนักงานตรวจคนเข้าเมือง (ตม.) โดยผู้ยื่นคำขอและลูกต้องเดินทางไปแสดงตัวด้วยตนเอง (ห้ามมอบอำนาจ)

เอกสารที่ต้องใช้ยื่น ตม.:

1. หลักฐานทางการเงิน (เลือกอย่างใดอย่างหนึ่ง):

• กรณีเงินฝาก: ต้องใช้บัญชีธนาคารในประเทศไทยเท่านั้น มีเงินฝากตั้งแต่ 400,000 บาทขึ้นไป และต้องฝากล่วงหน้าอย่างน้อย 2 เดือนก่อนวันยื่นขออยู่ต่อ

• กรณีรายได้: ใบรับรองรายได้ไม่น้อยกว่า 40,000 บาทต่อเดือน ซึ่งต้องผ่านการรับรองเอกสารจากหน่วยงานต้นทางหรือสถานทูตในไทย
  (⚠️ ข้อควรระวัง: สถานทูตบางประเทศในไทยไม่รับทำส่วนนี้ หรือคิวยาวมาก ควรเช็กให้ดีก่อน)

• หมายเหตุ: เอกสารทางการเงิน ตม. ส่วนใหญ่ยอมรับภาษาอังกฤษ ไม่ต้องแปลเป็นไทย

2. สำเนาสูติบัตรไทย และสำเนาทะเบียนบ้านไทยของลูก

3. หลักฐานการศึกษา (ถ้ามี): หนังสือรับรองจากโรงเรียน (กรณีลูกกำลังเรียนอยู่) พร้อมแนบรูปถ่ายบิดาหรือมารดาถ่ายคู่กับบุตรที่หน้าโรงเรียน (ถ่ายไว้ไม่เกิน 6 เดือน)

4. สำเนาหนังสือเดินทาง: หน้าที่มีรูปถ่าย, หน้าวีซ่า NON-O แรกที่ใช้เข้าเมือง, และหน้ารอยตราประทับขาเข้าล่าสุด

5. ใบแจ้งที่พักอาศัย: เอกสาร ตม.30 และ ตม.6 TDAC

🟢 The Pros

• Secured Status: If a Thai spouse passes away or a divorce occurs, the foreign parent does not lose their legal status. You can simply switch your visa basis to “dependent child” and continue staying in Thailand.

• Overseas-Born Children Eligible: Children born abroad can obtain a Thai birth certificate and eventually a Thai passport, allowing them to live in Thailand permanently without needing a visa.

• No Age Limit: There is no age restriction for the child; a foreign parent can apply regardless of whether the child is a minor or an adult.

• Simpler Paperwork: Once you have the Thai birth certificate, the process is straightforward. You skip the tedious process of translating and certifying foreign marriage certificates through foreign embassies and the Thai Ministry of Foreign Affairs (MFA).

🔴 The Cons

• Same Financial Threshold: The financial requirements remain identical to the Thai Spouse Visa (either 400,000 THB in a Thai bank or a monthly income of 40,000 THB).

✔️ The child must be the biological offspring of at least one Thai parent (granting them Thai citizenship by birth).

✔️ Adopted children are strictly NOT eligible under any circumstances.

✔️ The applicant and the child must present themselves in person for an interview either at a Royal Thai Embassy/Consulate abroad or at a local district office (Amphoe) in Thailand.

1. Foreign Birth Certificate:

• If applying at a Thai Embassy abroad: The original foreign birth certificate must be certified by the relevant government authority of that country.

• If applying at a District Office in Thailand: The child’s foreign passport + original foreign birth certificate must be certified by the home country’s embassy in Thailand, translated into Thai, and officially legalized by the Thai Department of Consular Affairs.

You must obtain an initial NON-O visa before arriving in Thailand. This specific visa category allows you to open a Thai bank account, which is mandatory for your long-term extension.

• What you get: An initial 90-day stay upon entry.

Documents to upload online:

• Completed online application form and visa fee payment.

Once you are in Thailand, you must apply for a 1-year extension before your initial 90-day visa expires. Both the foreign parent and the child must appear in person at the Immigration Office (Power of Attorney is not allowed).

Required Documents for Immigration:

1. Financial Proof (Choose One):

• Bank Deposit Option: A Thai bank account showing a balance of at least 400,000 THB. The money must be seasoned in the account for at least 2 months prior to the application date.

• Monthly Income Option: An official income certificate proving a monthly income of no less than 40,000 THB. This document must be legally certified by your home country’s embassy in Thailand or relevant authorities.
  (⚠️ Caution: Some embassies in Bangkok no longer provide income verification letters or have massive booking backlogs. Check your embassy’s current rules in advance).

• Note: Most Immigration offices accept financial documents in English without requiring a Thai translation.

2. Child’s Thai Birth Certificate and Thai House Registration (Tabien Baan) (Originals + Copies).

3. School Documents (If applicable): A confirmation letter from the child’s school (if currently enrolled) and recent photos (taken within the last 6 months) of the parent and child together in front of the school.

4. Passport Copies: The photo page, the page containing the original NON-O visa stamp, and the latest Thai entry stamp page.

5. Proof of Residence: TM.30 notification receipt and TM.6 (if applicable/TDAC).
