เตรียมตัวให้พร้อม! ถ้ากำลังวางแผนจะแต่งงานและจดทะเบียนสมรสกับชาวต่างชาติ เพราะตั้งแต่วันที่ 15 กันยายน 2569 เป็นต้นไป กฎฟรีวีซ่าเข้าประเทศไทยจะปรับลดเหลือเพียง 30 วัน (สามารถขอต่ออายุในไทยเพิ่มได้อีก 30 วัน รวมเป็น 60 วัน) จากเดิมที่เคยได้ 60 วันแล้วต่อเพิ่มได้อีก 30 วัน (รวม 90 วัน)
ระยะเวลาที่ลดลงนี้ หากไม่ได้เตรียมตัวมาอย่างดีตั้งแต่แรก มีโอกาสสูงมากที่จะจดทะเบียนสมรสและทำเรื่องไม่ทันเวลา
⬩➤ 1. ความเข้าใจผิดเรื่องทะเบียนสมรส
- จดทะเบียนสมรสแล้ว ไม่ได้แปลว่าชาวต่างชาติจะอยู่ไทยได้ทันที
- ทะเบียนสมรสไม่ใช่เอกสารสิทธิ์ในการพำนัก แต่เป็นเพียง “เอกสารประกอบ” ที่ใช้สำหรับยื่นขอวีซ่าติดตามคู่สมรส (Non-O) เท่านั้น
- การขอวีซ่าติดตามคู่สมรส (Non-O) ไม่สามารถทำในประเทศไทยได้ ต้องออกไปยื่นขอนอกประเทศเท่านั้น
⬩➤ 2. ขั้นตอนการเตรียมเอกสารจดทะเบียนสมรส (ต้องทำล่วงหน้า)
สิ่งที่สำคัญและใช้เวลามากที่สุดคือ ใบรับรองความเป็นโสด (Single Status Certificate) ของฝ่ายต่างชาติ
1. ขอใบรับรองโสดจากประเทศต้นทาง:
- ควรขอเอกสารและผ่านกระบวนการรับรองจากประเทศของตนเองมาให้เรียบร้อยก่อนเดินทางมาไทย
2. การรับรองเอกสาร (2 สเต็ป):
- ต้องผ่านการรับรองจากกระทรวงการต่างประเทศของประเทศนั้นๆ
- ต้องผ่านการรับรองจากสถานทูตไทย ณ ประเทศนั้นๆ
3. แปลเอกสารและรับรองคำแปล:
- เมื่อได้ใบโสดมาแล้ว ต้องนำมาแปลเป็นภาษาไทย และนำไปรับรองคำแปลที่กรมการกงสุล (กระทรวงการต่างประเทศ) ในไทย
4. นัดหมายที่ว่าการอำเภอ:
- ไม่ใช่ทุกอำเภอที่จะรับจดทะเบียนสมรสกับชาวต่างชาติ หรือมีเจ้าหน้าที่ที่เชี่ยวชาญ/พร้อมสัมภาษณ์
- ฝ่ายไทยต้องทำการสอบถามและนัดหมายวันเข้าจดทะเบียนกับทางอำเภอล่วงหน้า
- ในวันจดทะเบียน ต้องจัดเตรียมพยาน 2 คน และต้องมีล่ามภาษาอย่างน้อย 1 คน
⬩➤ 3. ขั้นตอนการขอวีซ่าติดตามคู่สมรส และการขออยู่ต่อระยะยาว
สเต็ปที่ 1: เดินทางออกนอกประเทศไทยเพื่อขอวีซ่า Non-O ▼
- ฝ่ายต่างชาติต้องเดินทางออกนอกประเทศไทย เพื่อไปยื่นขอ Visa Non-O (ติดตามคู่สมรส) ผ่านระบบออนไลน์ (Thai eVisa) ที่สถานทูตไทยในต่างประเทศ (ดีที่สุดคือกลับไปทำที่ประเทศบ้านเกิด)
- ข้อควรระวัง: ห้ามยื่นขอ Thai eVisa ขณะที่ตัวยังอยู่ในประเทศไทย เพราะระบบมีเงื่อนไขว่าผู้ยื่นต้องไม่อยู่ในไทย หากตรวจพบจะถูกปฏิเสธวีซ่าทันที
- เอกสารที่ใช้ยื่นวีซ่า Non-O: ทะเบียนสมรสไทย, เอกสารแสดงการเงินในบัญชีธนาคารต่างชาติของตนเองไม่น้อยกว่า 400,000 บาท และเอกสารอื่นๆ ตามที่สถานทูตกำหนด (เอกสารภาษาท้องถิ่นสามารถใชุยื่นที่สถานทูตไทยในประเทศนั้นๆ ได้เลย)
- เมื่อได้รับวีซ่า Non-O ทางอีเมลแล้ว จึงค่อยเดินทางกลับเข้ามาในประเทศไทย (วีซ่านี้จะให้อยู่ได้เบื้องต้น 90 วัน)
สเต็ปที่ 2: เปิดบัญชีธนาคารในประเทศไทย ▼
เมื่อเดินทางกลับเข้าไทยด้วยวีซ่า Non-O แล้ว ให้นำเอกสารประกอบด้วย พาสปอร์ต, วีซ่า Non-O และทะเบียนสมรสไทย ไปติดต่อเปิดบัญชีธนาคารในไทย (แนะนำธนาคารกสิกรไทย เนื่องจากมีหลักเกณฑ์การใช้เอกสาร 3 อย่างนี้ระบุไว้อย่างชัดเจน)
สเต็ปที่ 3: โอนเงินและฝากเงินค้างบัญชี 2 เดือน ▼
- โอนเงินจำนวน 400,000 บาท เข้ามาเก็บไว้ในบัญชีธนาคารไทยที่เพิ่งเปิด
- เงินจำนวนนี้ต้องฝากค้างไว้ในบัญชีอย่างน้อย 2 เดือนต่อเนื่อง ตามเกณฑ์ของสำนักงานตรวจคนเข้าเมือง (ตม.)
สเต็ปที่ 4: ยื่นขออยู่ต่อระยะยาว 1 ปี (Extension of Stay) ▼
- เมื่อฝากเงินครบ 2 เดือนแล้ว ให้นำหลักฐานทางการเงินและเอกสารสมรสไปยื่นเรื่อง “ขออยู่ต่อ” ที่ ตม.
- หากอนุมัติ จะได้รับสิทธิ์พำนักในประเทศไทยต่อได้อีก 1 ปีเต็ม และสามารถยื่นขอต่ออายุได้เรื่อยๆ ปีละ 1 ครั้ง
⬩➤ ทำไมถึงเปลี่ยนวีซ่าเป็น Non-O ในประเทศไทยเลยไม่ได้?
เนื่องจาก ตม. ในไทยมีเงื่อนไขว่าจะต้องมี บัญชีธนาคารไทยที่มีเงินฝากค้างไว้ จึงจะเปลี่ยนประเภทวีซ่าได้ แต่ในทางกลับกัน ธนาคารในไทยก็มีเงื่อนไขว่าผู้ขอเปิดบัญชีจะต้องมี วีซ่า Non-O เสียก่อนถึงจะยอมให้เปิดบัญชีได้ เกิดเป็นข้อจำกัดที่ขัดแย้งกัน การเดินทางออกไปขอวีซ่า Non-O จากนอกประเทศก่อนจึงเป็นวิธีที่ถูกต้อง ราบรื่น และปลอดภัยที่สุด

- ฝ่ายต่างชาติขอใบโสดและรับรองเอกสารมาจากประเทศตนเอง

Is 60 days enough to register a marriage with a foreigner in Thailand?

If you plan to register a marriage in Thailand with a foreign partner entering visa-free (30-day stay), you must prepare everything in advance. 30 days is a very short time, and without proper preparation, you will easily run out of time.
⬩➤ 1. Key Facts You Must Know
- A Marriage Certificate IS NOT a Visa: Registering your marriage does not automatically allow your foreign partner to stay in Thailand legally long-term.
- You Cannot Get a Non-O Visa Inside Thailand: You cannot convert a tourist stay into a Marriage Visa (Non-Immigrant O) inside Thailand. The foreign spouse must leave Thailand to apply for this visa at a Thai Embassy abroad.
⬩➤ 2. Preparing Documents for Marriage Registration (Do This in Advance)
The most critical document is the foreign partner’s Single Status Certificate (Affidavit of Freedom to Marry).
1. Get the Certificate from Home: Get the Single Status Certificate from their home country before traveling to Thailand.
2. Legalize the Document (2 Steps):
- Certified by the Ministry of Foreign Affairs in their home country.
- Certified by the Royal Thai Embassy in their home country.
- Note: Some foreign embassies in Thailand do not issue or certify this document locally (e.g., US, UK, Norway, Belgium). Doing this in their home country beforehand is the safest option.
3. Translate & Legalize in Thailand: Once in Thailand, translate the certificate into Thai and have the translation certified by the Department of Consular Affairs (Ministry of Foreign Affairs) in Thailand.
4. Book a District Office (Amphoe):
- Not all district offices handle international marriages.
- Contact and schedule an appointment with a local district office in advance.
- Bring 2 witnesses and an official interpreter on the registration day.
⬩➤ 3. Check-In with the Airline
Step 1: Leave Thailand & Apply for a Non-O Visa ▼
- After getting the Marriage Certificate, the foreign spouse must depart Thailand.
- Apply for a Non-Immigrant O (Marriage) Visa online via the Thai eVisa website from outside Thailand (ideally in their home country).
- Warning: Do NOT apply for the eVisa while physically inside Thailand, as the application will be rejected.
- Requirements: Thai Marriage Certificate, proof of foreign bank account balance (at least 400,000 THB equivalent), and personal documents.
- Once approved via email, return to Thailand (grants an initial 90-day stay).
Step 2: Open a Thai Bank Account ▼
- After returning on the Non-O Visa, visit a Thai bank (e.g., Kasikornbank).
- Required Documents: Passport, Non-O Visa stamp, and Thai Marriage Certificate.
⬩➤ Step 3: Transfer & Hold 400,000 THB ▼
- Deposit 400,000 THB into the newly opened Thai bank account.
- Keep the money in the account for at least 2 full months.
⬩➤ Step 4: Apply for a 1-Year Extension ▼
- After holding the deposit for 2 months, apply for a 1-Year Extension of Stay based on marriage at Thai Immigration.
- This extension can be renewed once every year inside Thailand.
⬩➤ Why Can’t You Change the Visa Inside Thailand?
To change your visa inside Thailand, Thai Immigration requires a Thai bank account holding 400,000 THB. However, Thai banks will not let a foreigner open a bank account without a Non-O Visa. Because of this rule, traveling abroad to get the Non-O Visa first is the only legal and smooth path.

- In Thailand: Translate to Thai, legalize at Consular Affairs, and register the marriage at a District Office.
