🔸 ทำไมจดทะเบียนแล้วถึงยังอยู่ไทยถาวรไม่ได้ทันที? ระบบกฎหมายไทยแยก “การแต่งงาน” ออกจาก “สิทธิ์การพำนัก” อย่างชัดเจน (เหมือนกับประเทศอื่นๆ ทั่วโลก) รัฐบาลจำเป็นต้องให้ขอวีซ่าแยกต่างหาก เพื่อตรวจสอบประวัติอาชญากรรม และความมั่นคงทางการเงินของชาวต่างชาติก่อน โดยวีซ่านี้จะต้องต่ออายุเป็นรายปี

❌“ถ้าไม่มีบัญชีธนาคารไทย จะเปลี่ยนวีซ่าในประเทศไม่ได้” แม้จะจดทะเบียนสมรสเรียบร้อยแล้ว แต่ถ้าฝ่ายต่างชาติยังไม่มีบัญชีธนาคารในไทย (ซึ่งต้องใช้โชว์เงินฝากตามเงื่อนไข) ก็จะไม่สามารถเปลี่ยนเป็นวีซ่า Non-O ข้างในไทยได้

✅ วิธีแก้: ส่วนใหญ่จะต้องบินออกไปขอวีซ่า Non-O จากสถานทูตไทยในต่างประเทศ (หรือยื่นผ่านระบบออนไลน์ E-Visa ของสถานทูตไทยในประเทศนั้นๆ) เพื่อใช้สิทธิ์วีซ่านี้เข้ามาเปิดบัญชีธนาคารในไทยให้ถูกต้อง

ตัวขั้นตอนที่อำเภอไม่ได้ยุ่งยาก แต่ส่วนที่ “ยากและใช้เวลาที่สุด” คือการเตรียมเอกสารของฝ่ายชาวต่างชาติ

📌 เอกสารสำคัญของฝ่ายต่างชาติที่ต้องมี:

1. พาสปอร์ต (ตัวจริงและสำเนา)
2. ใบรับรองโสด (Single Status Certificate) เพื่อยืนยันว่าไม่ได้ค้างทะเบียนสมรสกับใครที่ประเทศบ้านเกิด
3. ใบหย่า หรือ ใบมรณบัตรของคู่สมรสเดิม (ถ้ามี)

⚠️ สิ่งที่ต้องทำกับเอกสารต่างชาติ (ขาดไม่ได้):

1. ต้องผ่านการรับรองเอกสารว่าเป็นของจริง (Legalization) จากสถานทูตหรือหน่วยงานที่เกี่ยวข้อง
2. ต้องแปลเป็นภาษาไทย
3. ต้องนำคำแปลภาษาไทยไปรับรองที่ กรมการกงสุล ในประเทศไทยอีกครั้ง

🔸 เผื่อเวลา: ขั้นตอนการจองคิวสถานทูตเพื่อขอใบรับรองโสด และขั้นตอนการรับรองเอกสารที่กงสุลไทยค่อนข้างใช้เวลา คิวอาจยาวมาก

🔸 เช็กกับอำเภอ/เขตล่วงหน้า: ไม่ใช่ทุกอำเภอจะเชี่ยวชาญเรื่องการจดทะเบียนสมรสกับชาวต่างชาติ แนะนำให้โทรนัดหมายและเช็กเงื่อนไขก่อน

🔸 เตรียมพยาน: วันจดทะเบียนจริง ต้องพา พยานไปด้วยอย่างน้อย 2 คน และอาจต้องมีล่ามช่วยแปลภาษาในการสัมภาษณ์เบื้องต้นกับนายทะเบียนด้วยครับ

✅ You can enter with a “Visa Exemption” (Tourist Visa Exemption) or a Tourist Visa first: This allows you to come to Thailand and complete the marriage registration process.

❌ You cannot stay long-term just by getting married: A Thai marriage certificate does not automatically grant you permanent residency. To stay long-term, the foreign partner must apply for a “Non-Immigrant O Visa (based on marriage)”.

🔴 Why can’t you stay permanently right after marriage? The Thai legal system separates “marriage” from “long-term residency rights” (just like most countries). The government requires you to apply for a proper visa so they can check your criminal background and financial stability. This visa must be renewed every year.

🔴“If you don’t have a Thai bank account, you cannot change your visa inside the country.” Even after getting married, if the foreign partner does not have a Thai bank account (which is required to show the necessary funds), you cannot switch to a Non-O visa while inside Thailand.

🟢 The Solution: Most couples choose to fly out of Thailand to apply for the Non-O Visa at a Thai Embassy abroad (or apply online via the Thai E-Visa system in their home country). Once you enter Thailand with this Non-O visa, you will have the proper legal status to open a Thai bank account.

The process at the local district office (Amphur) is actually quite simple. The “hardest and most time-consuming part” is preparing the paperwork for the foreign partner.

📌 Required Documents for the Foreign Partner:

1. Passport (Original and copy)
2. Affidavit of Freedom to Marry (Single Status Certificate): To prove that you are legally single and free to marry.
3. Divorce Certificate or Death Certificate of previous spouse (if applicable).

⚠️ What You MUST Do with Foreign Documents:

1. They must be certified (legalized) as real documents by your embassy or relevant government authority.
2. They must be translated into Thai.
3. The Thai translations must be certified by the Department of Consular Affairs in Thailand.

✅ Plan ahead: Booking an appointment at your embassy for the Single Status Certificate and getting documents certified at the Thai Consular Affairs office can take a lot of time.

✅ Check with the local office first: Not all district offices (Amphur) are experienced with foreign marriage registrations. It is best to call ahead, make an appointment, and check their specific requirements.

✅ Bring witnesses: On the registration day, you must bring at least 2 witnesses. You might also need a translator to help during the brief interview with the registrar.
