คนไทยที่ใช้ชีวิตในต่างประเทศ แต่พาสปอร์ตไทยเกิดหมดอายุ ทำเล่มใหม่ไม่ทัน หรือพาสปอร์ตหาย/ชำรุด จะเข้าไทยได้มั้ย?

คำตอบคือ “เข้าได้” เพราะตามกฎหมายไทย คนสัญชาติไทยย่อมมีสิทธิเดินทางกลับเข้าประเทศเสมอ

เมื่อเดินทางมาถึงด่านตรวจคนเข้าเมือง (ตม.) ที่ประเทศไทย เจ้าหน้าที่ ตม. จะตรวจสอบข้อมูลสัญชาติไทยในระบบ และอนุญาตให้เข้าประเทศทันที

⚠️ข้อระวังสำคัญ : แม้ ตม. ไทยจะอนุญาตให้เข้าเมือง แต่ สายการบินต้นทางอาจปฏิเสธไม่ให้ขึ้นเครื่อง ตั้งแต่สนามบินต่างประเทศ เพราะกฎสากลของสายการบินส่วนใหญ่ต้องใช้เอกสารเดินทางที่มีอายุใช้งาน
แต่คนส่วนใหญ่มัก ใช้พาสปอร์ตต่างประเทศเช็คอินตอนขึ้นเครื่องอยู่แล้ว

✅ทางออกที่ดีที่สุด: ขอเอกสารฉุกเฉินจากสถานเอกอัครราชทูต/สถานกงสุล

หากพาสปอร์ตหมดอายุหรือทำเล่มใหม่ไม่ทัน ให้ติดต่อสถานทูตหรือสถานกงสุลไทยในประเทศที่คุณอยู่ เพื่อขอเอกสารเดินทางชั่วคราวอย่างใดอย่างหนึ่งดังนี้:

1. เอกสารสำคัญประจำตัว (Certificate of Identity – CI)
   • คืออะไร: เอกสารรับรองตัวบุคคลแบบชั่วคราว ใช้แทนพาสปอร์ตสำหรับ เดินทางกลับประเทศไทยได้เที่ยวเดียว (One-way trip) เท่านั้น
   • ใช้เมื่อไหร่: พาสปอร์ตหมดอายุ สูญหาย ชำรุด หรือยังไม่มีพาสปอร์ตเล่มใหม่ และมีความจำเป็นเร่งด่วนต้องกลับไทย
   • หมดอายุเมื่อไหร่: เมื่อคุณเดินทางถึงประเทศไทยและผ่านด่าน ตม. เรียบร้อยแล้ว เอกสาร CI จะหมดภาระหน้าที่ทันที ไม่สามารถใช้เดินทางต่อออกนอกประเทศได้อีก
     
2. หนังสือเดินทางฉุกเฉิน (Emergency Passport / ETD)
   • คืออะไร: เล่มพาสปอร์ตชั่วคราว (ส่วนใหญ่มีอายุ 1 ปี) สำหรับกรณีที่มีเหตุจำเป็นเร่งด่วนจริงๆ และต้องเดินทางต่อไปยังประเทศอื่นก่อนกลับไทย

👉 พาสปอร์ตไทยหมดอายุ ยังสามารถเข้าไทยได้
โดยมีการสอบสวนพิสูจน์ว่าเป็นคนไทย และบันทึกประวัติไว้ แล้วแจ้งให้ไปทำพาสปอร์ตเล่มใหม่ภายในประเทศ

3.1 กรณีพิสูจน์ได้ว่าเป็นคนไทยแน่นอน
หากมีหลักฐานอย่างใดอย่างหนึ่งต่อไปนี้:

• บัตรประชาชนไทย
• ทะเบียนบ้านไทย
• มีข้อมูลในระบบทะเบียนราษฎร์
• มีประวัติการเดินทางออกนอกประเทศย้อนหลังที่ตรวจสอบได้

3.2 กรณีไม่สามารถพิสูจน์สัญชาติไทยได้ชัดเจน

• ไม่มีบัตรประชาชน
• ไม่มีเอกสารยืนยันสัญชาติ
• ไม่พบข้อมูลในระบบทะเบียนราษฎร์
• ไม่มีหลักฐานการเดินทางออกนอกประเทศ

แนวทางปฏิบัติ

• ผู้โดยสารจะถูกส่งไปยัง งานพิธีการเข้าเมือง
• เจ้าหน้าที่จะดำเนินการ ตรวจสอบเพิ่มเติมก่อนอนุญาตให้เข้าประเทศ

หลักการง่ายๆคือ

• “ซื้อตั๋วด้วยพาสปอร์ตเล่มไหนก็ได้ที่ทำให้เราเข้าประเทศปลายทางได้สะดวกที่สุด (ไม่ต้องทำวีซ่า)”

โดยยึดหลัก

• “ข้อมูลบนตั๋ว ต้องตรงกับเล่มที่ยื่นให้สายการบินตอนเช็กอิน”

ตัวอย่างเช่น: คนไทยถือพาสปอร์ตไทยและUK

• บินออกจากอังกฤษ → กลับไทย
  • ซื้อตั๋ว+เช็คอิน = พาสปอร์ตไทย
  • ผ่านตม.UK = พาสปอร์ต UK
  • ผ่านตม.ไทย = พาสปอร์ตไทย

• บินออกจากไทย → ไป UK
  • ซื้อตั๋ว+เช็คอิน = พาสปอร์ต UK
  • ผ่านตม.ไทย = พาสปอร์ตไทย
  • ผ่านตม.UK = พาสปอร์ต UK

• Entering Thailand with a Thai passport $\rightarrow$ When flying out of Thailand, you must use your Thai passport.
• Entering Thailand with a foreign passport $\rightarrow$ When flying out of Thailand, you must use your foreign passport.

Why can’t you swap passports midway?

Because if you swap them, the Immigration Bureau system will not record complete information. For example:

• If you enter Thailand using a foreign passport, stay for a while, get a new Thai passport made in Thailand, and then try to use your Thai passport to fly out: Your foreign passport will have no record of exiting Thailand. If detected, you will face prosecution for Overstaying.
• If you enter Thailand using a Thai passport but attempt to exit using a foreign passport: You will definitely run into trouble because your foreign passport has no record of entry into Thailand.

For Thai nationals living abroad whose Thai passport expires, cannot be renewed in time, or is lost/damaged, can they still enter Thailand?

The answer is “YES.” Under Thai law, Thai citizens always have the right to return to their home country.

When you arrive at the Immigration checkpoint in Thailand, Immigration officers will verify your Thai citizenship status in the system and allow you entry immediately.

⚠️ Important Warning: Even though Thai Immigration will allow you entry, the airline at your origin airport abroad may refuse to let you board in the first place. This is because international rules for most airlines require a valid travel document.

However, most dual citizens already use their foreign passport to check in at boarding anyway.

✅ The Best Solution: Apply for Emergency Travel Documents at the Embassy / Consulate

If your passport has expired or you cannot renew it in time, contact the Royal Thai Embassy or Consulate in your country of residence to apply for one of the following temporary travel documents:

1. Certificate of Identity (CI)
   • What is it? A temporary identity certificate used in place of a passport for a one-way trip back to Thailand only.
   • When to use it? When your passport is expired, lost, damaged, or you do not have a new passport yet and need to return to Thailand urgently.
   • When does it expire? As soon as you arrive in Thailand and pass through Immigration, the CI fulfills its purpose and expires immediately. It cannot be used for further international travel.
2. Emergency Passport / Emergency Travel Document (ETD)
   • What is it? A temporary passport (mostly valid for 1 year) meant for urgent situations where you must travel to other countries before returning to Thailand.

👉 An expired Thai passport can still be used to enter Thailand.

An investigation will be conducted to prove your Thai identity, the event will be recorded, and you will be instructed to apply for a new passport within Thailand.

3.1 In cases where Thai citizenship can be definitively proven:

If you possess any of the following evidence:

• Thai National ID card
• Thai House Registration (Tabien Baan)
• Information in the Civil Registration system
• Verifiable historical records of exiting the country

3.2 In cases where Thai citizenship cannot be clearly proven:

• No National ID card
• No document confirming citizenship
• No record found in the Civil Registration system
• No proof of prior travel out of the country

Procedure:

The passenger will be referred to the Immigration Formalities Division, where officers will perform additional verification before granting entry to the country.

The simple rule is:

“Buy your ticket using whichever passport makes entering your destination country most convenient (no visa required).”

Subject to the rule:

“The information on the ticket must match the passport presented to the airline at check-in.”

Example: A person holding both Thai and UK passports:

• Flying out of the UK $\rightarrow$ Returning to Thailand:
  • Buy ticket + Check-in: Use Thai passport
  • Pass UK Immigration: Use UK passport
  • Pass Thai Immigration: Use Thai passport
• Flying out of Thailand $\rightarrow$ Heading to the UK:
  • Buy ticket + Check-in: Use UK passport
  • Pass Thai Immigration: Use Thai passport
  • Pass UK Immigration: Use UK passport
