ตม. จะนับจำนวนวัน Overstay ตั้งแต่

วันหมดอายุที่อนุญาตให้อยู่ในไทย → จนถึงวันที่ออกจากประเทศ

🛂Overstay ไม่เกิน 90 วัน (มอบตัวเอง)

• ปรับ 500 บาท/วัน
• ปรับสูงสุดไม่เกิน 20,000 บาท

ในกรณีนี้ บางคนไม่โดนแบน แต่ต้องดูว่าในพาสปอร์ตมี ตราประทับสีแดง ระบุว่า “ห้ามเข้าประเทศไทย … ปี” หรือไม่

ถ้าไม่มีตราแบน แปลว่า “ยังไม่โดนแบน”
แต่การเข้าไทยครั้งต่อไปมักถูกเพ่งเล็งแน่นอน

🛂Overstay เกิน 90 วัน แต่ไม่เกิน 1 ปี (มอบตัวเอง)

➜ โดนแบน 1 ปี

🛂อยู่เกินเกิน 1 ปี แต่ไม่เกิน 3 ปี (มอบตัวเอง)

➜ โดนแบน 3 ปี

🛂อยู่เกินเกิน 3 ปี แต่ไม่เกิน 5 ปี (มอบตัวเอง)

➜ โดนแบน 5 ปี

🛂อยู่เกินเกิน 5 ปี (มอบตัวเอง)

➜ โดนแบน 10 ปี

2) กรณี “ถูกจับกุม” ระหว่าง Overstay (โทษหนักกว่า)

กรณีนี้หมายถึงการที่ไม่ได้ไปแจ้ง ตม. เอง และถูกจับได้ เช่น

• ถูกตรวจระหว่างอยู่ในไทย
• หรือถูกตรวจตอนออกจากไทย (ด่าน ตม. สนามบิน)

โทษแบนจะหนักกว่ากรณีมอบตัว

➜ โดนแบน 5 ปี

🛂อยู่เกินเกิน 1 ปี (ถูกจับ)

➜ โดนแบน 10 ปี

3) โดนปรับ แต่ไม่โดนแบน ยังเข้าไทยฟรีวีซ่าได้ไหม?

ถ้าโดนแค่ “ปรับ” และในพาสปอร์ต ไม่มีตราประทับแบนสีแดง
โดยหลักแล้ว ยังสามารถเข้าไทยได้

แต่ต้องเข้าใจว่า…

• ตม. สามารถเห็นประวัติ Overstay จากตราขาเข้า-ออกเดิม
• โอกาสถูกถามละเอียดมีสูง
• อาจถูกขอเอกสารเพิ่ม หรือถูกปฏิเสธการเข้าเมืองได้ถ้าตอบไม่ชัด

แนะนำให้เตรียมเอกสารไว้เสมอ เช่น

• ตั๋วขาออก
• หลักฐานเงิน
• ที่พัก
• เหตุผลที่เคยอยู่เกิน (ถ้ามีหลักฐานจะช่วยมาก)โทษแบนจะหนักกว่ากรณีมอบตัว

4) เคย Overstay แล้ว ยังขอวีซ่าไทยใหม่ได้ไหม?

หลายคนคิดว่า “ครั้งหน้าขอวีซ่า Non-O หรือ DTV ก็จบ”
แต่จริง ๆ แล้ว ไม่ใช่ทางหนี เพราะสถานทูตสามารถตรวจสอบประวัติได้

กรณีโดนปรับ แต่ไม่โดนแบน

ยังสามารถยื่นวีซ่าได้ เช่น

• Non-O คู่สมรส
• Non-O เกษียณ
• Tourist Visa (TR)
• DTV

แต่ จะถูกเพ่งเล็งหนักขึ้น และสถานทูตอาจเรียกเอกสารเพิ่ม เช่น

• อธิบายเหตุผลที่เคย Overstay
• หลักฐานการเงิน
• หลักฐานงาน
• แผนการเดินทาง
• ตั๋วขาออก

กรณีโดนแบน

ถ้าโดนแบนแล้ว จะมีผลทันทีว่า

❌ ระหว่างถูกแบน ยื่นวีซ่าใด ๆ ไม่ได้
ต้องรอให้พ้นระยะเวลาห้ามเข้าประเทศก่อนเท่านั้น

เมื่อครบกำหนดแบนแล้ว
✅ สามารถยื่นวีซ่าใหม่ได้ตามปกติ

1) Overstay Case: Voluntary Surrender (You Report Yourself)

In this case, Immigration calculates the number of overstay days from:

The day your permission to stay expires → until the day you leave Thailand

🛂Overstay Less Than 90 Days (Voluntary Surrender)

• Fine: 500 THB per day
• Maximum fine: 20,000 THB

In many cases, this does not automatically mean a ban, but you must check your passport for a red stamp stating:

“Prohibited from entering Thailand for … years”

If there is no red stamp, you may not be banned.
However, your next entry to Thailand will likely be closely questioned.

➜ 1-year ban from entering Thailand

🛂Overstay More Than 1 Year but Less Than 3 Years (Voluntary Surrender)

➜ 3-year ban

🛂Overstay More Than 3 Years but Less Than 5 Years (Voluntary Surrender)

➜ 5-year ban

🛂Overstay More Than 5 Years (Voluntary Surrender)

➜ 10-year ban

2) Overstay Case: Arrested During Overstay (More Serious Penalty)

This case applies if you do not report yourself and Immigration catches you, such as:

• being arrested during immigration checks inside Thailand
• being caught at the airport when trying to leave Thailand
• being reported and detained

Penalties are much harsher than voluntary surrender.

3) Can You Re-Enter Thailand If You Only Paid a Fine (No Ban)?

If you only paid the fine and there is no red ban stamp in your passport, technically:

✅ You are not officially banned
✅ You may still enter Thailand again (including visa exemption)

However, you should expect:

• heavy questioning at immigration
• increased scrutiny of your travel history
• possible refusal of entry if your answers are unclear

It is strongly recommended to carry supporting documents, such as:

• return flight ticket
• hotel booking / address in Thailand
• proof of funds
• explanation for why the overstay happened (if applicable)

4) Can You Apply for a New Thai Visa After Overstay?

Some people believe they can avoid the consequences by applying for another visa later, such as:

• Non-O Marriage
• Non-O Retirement
• Tourist Visa (TR)
• DTV Visa

But this is not a “safe escape route.”

Thai embassies and immigration systems can check your overstay history.

If You Paid a Fine but Were Not Banned

Yes, you can still apply for a Thai visa.

However, your application may be considered higher-risk, and the embassy may request extra documents such as:

• written explanation of the overstay
• proof of employment / income
• stronger financial evidence
• full travel plan
• proof of accommodation
• return ticket

If You Were Banned

❌ You cannot apply for any Thai visa during the ban period
❌ You must wait until the ban ends

Once the ban period is over:

✅ You can apply again normally
