ปัญหาการถูกส่งกลับประเทศของชาวต่างชาติที่เดินทางเข้าไทยส่วนใหญ่มักเกิดจากการไม่ทำวีซ่าให้ถูกต้อง หรือเข้ามาโดยใช้สิทธิ์ฟรีวีซ่าซ้ำๆ จนเกินโควต้า ซึ่งตม. (ตรวจคนเข้าเมือง) ได้ปรับเปลี่ยนมาตรการตรวจสอบและแจ้งเตือนชาวต่างชาติตั้งแต่ช่วงปลายปี 2025 โดยเฉพาะกลุ่มที่เข้าออกบ่อยหรือพยายามพำนักให้นานที่สุด
⬩➤ 1. โควต้าและการพิจารณาของ ตม.
- สิทธิ์ฟรีวีซ่า: กำหนดให้ใช้ได้ 30 วันต่อครั้ง และใช้ได้สูงสุดเพียง 2 ครั้งต่อปี (กรณีอยู่เต็ม 30 วัน และขออยู่ต่ออีก 30 วัน)
- การเข้าไทยครั้งที่ 1: ผ่านได้ตามปกติ
- การเข้าไทยครั้งที่ 2: ตม. เริ่มพิจารณาประวัติและเจตนา โดยดูจากระยะเวลาการพำนักในครั้งก่อนหน้า
- กรณีพำนักเต็มสิทธิ์ (ครั้งละ 30 วัน): ตม. จะแจ้งเตือนทันทีในครั้งที่ 2 ว่าโควต้าใกล้หมด และครั้งถัดไปจำเป็นต้องขอวีซ่าล่วงหน้า หากไม่ปฏิบัติตามจะถูกปฏิเสธการเข้าเมืองและส่งตัวกลับทันที
- การใช้อำนาจของ ตม.: เจ้าหน้าที่ ตม. มีอำนาจตัดสินใจเด็ดขาดว่าจะอนุญาตให้ผู้ใดเข้าประเทศหรือไม่ ดังนั้นชาวต่างชาติควรปฏิบัติตามคำเตือนอย่างเคร่งครัด
⬩➤ 2. คำแนะนำในการเตรียมตัว
กรณีเข้ามาบ่อยแต่พำนักสั้น (ไม่เกิน 2 สัปดาห์/ครั้ง):
- ในการเดินทางครั้งที่ 3 เป็นต้นไป ควรเตรียมเอกสารยืนยันความบริสุทธิ์ใจเพิ่มเติม เช่น ตั๋วเครื่องบินขากลับ, หลักฐานการจองที่พัก/โรงแรม หรือกรณีพักกับคนไทย ให้เตรียมสำเนาบัตรประชาชน/ทะเบียนบ้านของผู้นำพัก รูปถ่ายคู่กัน หรือจดหมายเชิญภาษาไทยสั้นๆ ที่ระบุช่วงเวลาและยืนยันการเดินทางกลับตามกำหนด
กรณีต้องการพำนักระยะยาว:
- หากมีการเดินทางกลับไปใช้ชีวิตหรือทำงานในประเทศตนเองจริงๆ (มีตราประทับเข้า-ออกประเทศตนเองชัดเจน) จะไม่พบปัญหาเรื่องเจตนาแอบแฝง
- เมื่อใช้สิทธิ์ฟรีวีซ่าครบโควต้าแล้ว ต้องยื่นขอวีซ่าออนไลน์ (E-Visa) จากประเทศของตนเองก่อนออกเดินทางเท่านั้น ไม่สามารถเข้ามาขอหรือเปลี่ยนประเภทวีซ่าภายในประเทศไทยได้
⬩➤ 3. ทางเลือกประเภทวีซ่าสำหรับการพำนักระยะยาว
วีซ่าท่องเที่ยว (Tourist Visa – TR):
- พำนักได้ 60 วัน และสามารถยื่นขอต่อเวลาได้อีก 30 วัน (รวมเป็น 90 วัน)
- หากวางแผนล่วงหน้าด้วยการขอวีซ่าท่องเที่ยวจากประเทศต้นทางก่อน แล้วค่อยใช้สิทธิ์ฟรีวีซ่าตามหลัง จะสามารถพำนักรวมได้สูงสุดประมาณ 180-187 วันต่อปี
- (TR 60 + ต่อ 30) + (ฟรี 30 + ต่อ 30) + (ฟรี 30 + ต่อ 7)
- หากเว้นระยะการเดินทางกลับประเทศตนเองประมาณ 3 เดือน แล้วยื่นขอวีซ่าท่องเที่ยวใหม่ (ขึ้นอยู่กับการพิจารณาของสถานทูต) อาจพำนักได้รวมสูงสุดถึง 9 เดือนต่อปี
วีซ่าพำนักระยะยาว (Non-Immigrant O):
- สำหรับผู้ที่มีคุณสมบัติตรงตามเกณฑ์ ได้แก่ ผู้ที่แต่งงานจดทะเบียนสมรสกับชาวไทย (ต้องมีเงินฝากในบัญชีตนเอง 400,000 บาท) หรือผู้ที่มีอายุ 50 ปีขึ้นไปเพื่อการเกษียณอายุ (ต้องมีเงินฝากในบัญชีตนเอง 800,000 บาท)
- เมื่อได้รับวีซ่า Non-O จะสามารถพำนักได้ทันที 90 วันโดยไม่ต้องยื่นขอต่อเวลาให้ยุ่งยาก และหลังจากนั้นยังสามารถเลือกใช้สิทธิ์ฟรีวีซ่าเสริมต่อได้ตามขั้นตอน

Most cases of foreigners being deported from Thailand happen because they do not apply for a proper visa or enter repeatedly using visa exemption until they exceed their limit. Immigration has updated its measures to monitor and warn foreigners since late 2025, especially those who visit frequently or try to stay as long as possible.
⬩➤ 1. Quota and Immigration Decisions
- Visa exemption rules: You can stay up to 30 days per visit, and you can only use it up to 2 times a year (if you stay the full 30 days and extend for another 30 days).
- First Entry to Thailand: Processed as normal.
- Second Entry to Thailand: Immigration begins reviewing travel history and intentions based on the length of the previous stay.
- Full Stay Cases (30 days per visit): On the second visit, Immigration will issue a warning that the quota is almost exhausted and a visa must be applied for in advance for the next trip. Foreigners who fail to comply will be denied entry and deported immediately.
- Immigration’s Authority: Immigration officers hold the absolute authority to decide whether to permit entry. Foreigners must strictly follow their warnings.
⬩➤ 2. Preparation Advice Based on Travel Patterns
Frequent Short Visits (under 2 weeks per visit):
- From the 3rd entry onward, prepare extra supporting documents to prove genuine tourist intent. Examples include a return flight ticket, hotel bookings, OR if staying with a Thai resident, a copy of the Thai host’s ID card and house registration, photos taken together, or a short invitation letter in Thai stating the duration of stay and guaranteeing a timely departure.
Long-Term Stays:
- Foreigners who actually return to live or work in their home country (with clear exit and entry stamps in their passport) will not face issues regarding hidden intentions.
- Once the visa exemption quota is used up, an online visa (E-Visa) must be applied for from one’s home country before traveling. It cannot be applied for or changed to inside Thailand.

Tourist Visa (TR):
- Permits a stay of 60 days and can be extended once for another 30 days (totaling 90 days).
- Planning ahead by obtaining a Tourist Visa from the home country first and using visa exemption afterward allows a total stay of around 180–187 days per year.
- (TR 60 + Extend 30) + (Free 30 + Extend 30) + (Free 30 + Extend 7)
- After returning home for about 3 months, applying for a new Tourist Visa (subject to embassy approval) could potentially allow a total stay of up to 9 months in a year.

- Available only to those who meet specific qualifications, such as individuals legally married to a Thai citizen (requiring 400,000 THB in a personal bank account) or individuals aged 50 and above for retirement (requiring 800,000 THB in a personal bank account).
- Holding a Non-O visa grants an immediate 90-day stay without the hassle of requesting extensions. Afterward, visa exemption rights can still be used to extend the total stay.
